1. Leadership Board Prizes: There will be ten (10) verified Winners in the Leaders Board for Walk and Run challenge’ and ten (10) verified Winners in the ‘Cycle Challenge’. Cumulative distance clocked must be during the ‘Event Period’ (21 November to 12 December 2021)

2.The BCCS Challenge 2021 Challengers Lucky Draw and Lucky Draw for race categories (the "Lucky Draw") is open to individuals who have provided their complete information in the prescribed format during registration and completed their race with verified submissions within the Event Period ("Participants"; each a "Participant").
a. ‘Challengers Lucky Draw’ is eligible for Participants of the ‘Walk and Run Challenge’ and ‘Cycle Challenge’ only.
b. ‘Lucky Draw’ is eligible for Participants of these 5 categories: ‘4km’, ‘10km’, ‘21km’, ‘Walk and Run Challenge’, ‘Cycle Challenge’.
c. Participants from FREE category (Walk/Run/Cycle) do not qualify for any of the draws.
d. Participant’s Code will be used for the lucky draw.
e. Winning Participant’s code will be removed from further draws once their code is drawn.

3. The Lucky Draw is open to Participants residing in Singapore only, it shall exclude employees of Bartley Community Care Services and the members of BCCS Challenge 2021 Organising Committee (‘Organiser’).

4. Lucky Draw Prizes
a. Challengers Lucky Draw
There will be six (6) winners in the Challengers Lucky Draw ‘Walk and Run challenge’ or ‘Cycle Challenge’ categories. The winner of the grand prize will receive Roomba 670 vacuum cleaner (worth $818) sponsored by iRobot. The winner of the second prize will receive ‘Jolly Grandville Hamper’ (worth $265) sponsored by Noel Gifts. The winner of the third prize will receive ‘Chocolate Wishes Hamper’ (worth $150) sponsored by Noel Gifts. The winner of fourth and fifth prize will receive ‘Best Bird's Nest’ (Bundle of 8 box worth $96) sponsored by Noel Gifts. The winner of the sixth prize will receive Santa’s Indulgence Hamper (worth $85) sponsored by Noel Gifts.

b. Lucky Draw
There will be twelve (12) winners in the Lucky Draw ‘walk and run challenge’ or ‘cycle challenge’ or any of the ‘4km’, ‘10km’, ‘21km’ race. The ten (10) winners will each receive FairPrice Gift vouchers worth $50 each sponsored by NTUC FairPrice Foundation. Subsequent two (2) winners will receive Noel Gift Vouchers worth $50 sponsored by Noel Gifts.

5. The Lucky Draw will be conducted on 15 December 2021 (the "Draw Date") and the winners will be announced and published on 17 December 2021, 5pm at https://www.facebook.com/bccschallenge/.

6. The Organiser will notify the winners via the email address submitted at the point of registration for the Lucky Draw within fourteen (14) working days from the Draw Date (the "Notification Email "). Bartley Community Care Services shall not be liable for late, lost, misdirected or unsuccessful efforts to contact and notify the prize winners.

7. The Notification Email will set out the procedure for prize redemption.

8. A winner who does not respond to the Notification Email within one (1) month from the date of the Notification Email may see their Prize forfeited, withdrawn, or given to beneficiaries at the sole and absolute discretion of Bartley Community Care Services.

9. Bartley Community Care Services reserves the right to vary the terms and conditions of this Lucky Draw at any time without prior notice. The Prize is not exchangeable for cash or for any other items.

10. Bartley Community Care Services makes no representation as to the quality or performance of the Prizes provided by the merchants in connection with the Lucky Draw. By participating in the Lucky Draw, the Participants acknowledge and accept that the use of each Prize is subject to the terms and conditions of the relevant merchant providing the Prize.

11. By participating in the Lucky Draw, each Participant agrees and consent to BCCS and its related corporations (collectively, the "Organisers"), as well as their respective representatives, the Organisers' partners and relevant third parties (the Organisers and all the other foregoing parties, collecting, using, disclosing, and/or sharing amongst themselves such personal data, for purposes reasonably required by the Organisers to conduct the Lucky Draw which the participant is signing up for and such other purposes as described in Bartley Community Care Services’ Privacy Statement (collectively, the “Purposes”) which is accessible from Bartley Community Care Services website, which each participant confirms they have read and understood.

12. The Organiser’s decisions in all matters related to the Lucky Draw, prizes and prize winners shall be final. No correspondence or appeals shall be entertained in relation thereto. 13. By participating in the Lucky Draw, Participants hereby agree to all the terms and conditions of participation in the Lucky Draw as set out herein, including all amendments, additions, replacements, and modifications hereto as may from time to time be made by Bartley Community Care Services, without prior notice and consent.


BCCS Challenge 2021


1. GENERAL

1.1 BCCS Challenge 2021 is organised by Bartley Community Care Services ("Organisers") in accordance with these Rules & Regulations (“Terms”) that is applicable to the Participants, which can be found at bit.ly/BCCSChallenge21("Official Website").

1.2 Completion and submission of the online registration form confirm that participant is deemed to have accepted and agreed to abide by these T&Cs and any amendments, additions and replacements hereto, which shall be final and binding in all respects on each participant.

1.3 The Participant agrees to (i) provide true, accurate, current and complete information about the Participant required by the Organisers in the online registration form (the "Registration Data"); and (ii) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. To the extent permitted by law, the Organisers shall not be liable for any claim, demand, liability or action resulting from the Participant’s omission, neglect and/or failure to supply the Organisers with the updated information and the accuracy and completeness of that information.

1.4 The Organisers may contact the Participant from time to time by email regarding race matters. Any notice sent to the email address registered with the Organisers shall be deemed as received by the Participant.

1.5 If the Participant provides any information that is untrue, inaccurate, not current or incomplete, or if the Organisers have grounds to suspect that such information is untrue, inaccurate, not current or incomplete, the Organisers may suspend or terminate the Participant's registration and refuse any and all future use of the Official Website (or any parts thereof). The Organisers shall not be held responsible for any disputes arising from incomplete entry details.

1.6 These Terms shall be governed by laws of Singapore, and the Participants and the Organisers agree to submit to the jurisdiction of the Singapore Courts.

1.7 The Organisers, its officers, employees, contractors and/or third-party service providers may take the Participants’ photographs, motion pictures, video, sound or any form of recordings during the event. The Organisers reserves the right to use such photographs, motion pictures, and/or recordings for any legitimate purposes, including commercial advertising.

1.8 The Organisers reserve the right to amend these Terms from time to time without giving prior notification or any reasons thereof.


2. REGISTRATION

2.1 Registration is open to worldwide participants, with a minimum age of 12. Participants below 18 years of age need to seek parental or guardian consent before participating in BCCS Challenge 2021. The Organisers have the absolute discretion to reject and refuse the registration of a potential participant without assigning any reason to the participant, and to terminate such registration for any reason whatsoever.

2.2 The Organisers reserve the right to cancel or postpone the Event at any time without prior notice to Participants, in which case the Organisers will make effort to inform Participants prior to the date of the Event. If the Event has to be cancelled or postponed, there shall be no refund in whole or part unless the Organisers deem fit to give a refund, and the Organisers shall not be held liable for any loss or inconvenience caused.

2.3 The Organisers reserve the right to set the fees for the different categories as expedient to its intents and purposes.

2.4 Participants may change the category (upgrade or downgrade) by paying a $15 administrative charge for the change of category. No refund of differences will be given if the participant chooses to downgrade the category. For upgrading of category, participants will need to top up the difference between the categories.

2.5 Participants who decide to downgrade their category (i.e. change of category to one of the shorter distances) must do so before 21 November 2021 (23:59) GMT +8. All requests for change must be in writing to hello@pinkaple.com.sg. Telephone and verbal notifications will not be accepted. Any differences in the amount paid will not be refunded.

2.6 Participants who wish to upgrade their category (i.e. change of category to one of the longer distance) must do so before 21 November 2021 (23:59) GMT +8. All requests for change must be in writing to hello@pinkapple.com.sg. Telephone and verbal notifications will not be accepted. Top up of registration fees will be required if there are any differences.

2.7 The Organisers reserve the right to limit and refuse registrations/entries without assigning any reasons thereof.

2.8 The Organiser shall not be held responsible or otherwise liable for any disputes arising out of and in connection with incomplete entry details.

2.9 When the Participant is required to pay, the Participant will be directed to a third-party website for payment (“Third Party Payment Services”). The Participant acknowledges that the Organiser is not liable or responsible for the availability or accuracy of such Third-Party Payment Services, or the content, privacy policies, practices, products or services of or available from, or any additional processing fees charged by, such Third-Party Payment Services, or any failure, disruption or error in connection with such Third-Party Payment Services. The Participant may be subjected to, or required to accept the additional terms and conditions of such Third-Party Payment Services.

2.10 In the event that a Participant does not eventually take part in the Race for any reason whatsoever, there will be no refund of his or her registration fees paid.


3. RACE

3.1 Run submissions received after 12 December 2021 (23:59) GMT +8 will not be considered.

3.2 Acceptable forms of proof are syncing through the Strava application or screenshot of your results using smartwatches and running applications (e.g. Garmin, Runkeeper and etc.).

3.3 Participants are allowed to submit their results that they use to submit to other online races as long as it is within the run & submission period (21 November 2021 - 12 December 2021) and that they have achieved the minimum distance.

3.4 The Organisers reserve the right to disqualify participant if fraudulent results are found.

3.5 The Organisers reserve the right to disqualify participant if a breach of the rule is found.

3.6 Participants below the age of 18 are required to seek parental/guardian consent and fill up the relevant indemnity form when registering online, failing which, the Organisers reserve the right to refuse entry to that Participant.


4. MEDICAL AND SAFETY

4.1 Participants take part at their own risks and the Organisers, their sponsors and their appointed officials shall not be liable for any death or injury, loss or damage, suffered or otherwise, and howsoever arising.

4.2 Participants are strongly encouraged to go for a medical examination and/ or consult their medical practitioner prior to registration and before their run. For the safety of Participants, Participants are advised to run on the designated route and observe traffic regulations.

4.3 Due to the current situation, participants should put on a mask after completing their activity. The Organisers, their sponsors and their appointed officials shall not be liable if the participant did not adhere to safe management principles.


5. CONFIDENTIALITY AND PERSONAL DATA

5.1 By visiting the Official Website, submitting the Participant’s Registration Data onto the Online Registration Portal and/or participating in the BCCS Challenge 2021, the Participant consents to the Organisers’ collection, use and disclosure of the Participant’s Registration Data for any or all of the purposes stated in the Privacy Statement.

5.2 To register for a Race, the Organiser may collect personal data including the Participant’s name, gender, date or birth, contact information, payment information, health information, or technical information.

5.3 The Organiser collects Personal Data (as defined in the PDPA) in the following ways: When a Participant contacts and communicates with the Organiser; When a Participant submits his or her registration form; When a Participant visits the Website; From the Third Party Payment Service provider; and When a Participant submits Personal Data to the Organiser.

5.4 Generally, the Organiser collects, uses, discloses and/or otherwise processes Personal Data for the following purposes: To perform obligations arising out of and in connection with its provision of services incidental and related to the T&C and Race; To verify the identity of a Participant; To respond to, handle, process queries, requests, applications, complaints and feedback from a Participant; To manage the relationship with a Participant; To process payment or credit transactions; To share with other sponsors of the Race; To comply with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority; For any other purposes for which Participants have provided the information; and Any other incidental purposes related to and in connection with the above.

5.5 The Organiser may disclose Personal Data of the Participants: Where such disclosure is required for performing obligations arising out of and in connection with its provision of services incidental and related to the Race; and/or To third party service providers, agents and other organisations engaged by the Organiser to perform any of obligations under or in connection with this T&C; and/or To sponsors of the Race where the Organiser has obtained the necessary consents and/or provided the necessary notifications, or as may be permitted under the law.

5.6 In the event that a Participant wishes to make (1) an access request for access to a copy of his or her personal data held by the Organiser or information about the ways in which the Organiser uses, discloses and/or otherwise processes such personal data; or (2) a correction request to correct and/or update any of his or her Personal Data held by the Organiser, he or she may submit his or her request in writing to challenge21@bccs.org.sg. A reasonable fee may be charged for any such access request and if applicable, the Organiser shall inform the Participant of the fee before processing any such request.

5.7 The Organiser will respond to any request by a Participant as soon as reasonably possible. Should the Organiser not be able to respond to a request within thirty (30) days after receiving the same, it will inform the Participant in writing within thirty (30) days of the time by which it will be able to respond to such request. If the Organiser is unable to provide a Participant with any Personal Data or to make a correction requested, it shall inform the Participant of the reasons why it is unable to do so (except where it is not required to do so under the Personal Data Protection Act (the “PDPA”)).

5.8 To safeguard a Participants’ personal data from unauthorised access, collection, use, disclosure, copying, modification, disposal and/or similar risks, the Organiser has introduced appropriate administrative, physical and/or technical measures such as up-to-date antivirus protection, encryption and/or the use of privacy filters to secure all storage and transmission of Personal Data, and shall disclose Personal Data both internally and to its authorised third party service providers and agents only on a need-to-know basis. However, Participants should be aware that no method of transmission over the internet or method of electronic storage is completely secure. Whilst security cannot be guaranteed, the Organiser strives to protect the security of Participants’ information and is constantly reviewing and enhancing its information security measures.

5.9 The Organiser generally relies on the Personal Data provided by Participants or their respective duly authorised representatives. In order to ensure that his or her Personal Data is current, complete and accurate, a Participant should update the Organiser accordingly if there are changes to his or her personal data by submitting his or her request in writing to challenge21@bccs.org.sg.

5.10 The Organiser may retain a Participant’s Personal Data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws. The Organiser will cease to retain a Participant’s Personal Data, or remove the means by which the data can be associated with such Participant, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the Personal Data was collected, and is no longer necessary for legal or business purposes.

5.11 The Organiser will not transfer a Participant’s Personal Data to countries outside of Singapore. However, if the Organiser does so, it will obtain such Participant’s consent for the transfer to be made and will take steps to ensure that the Personal Data continues to receive a standard of protection that is at least comparable to that provided under the PDPA.


6. DISCLAIMER; LIMITATION OF LIABILITY

6.1 The Organisers represent or warrants that the online registration portal and/or the Official Website will always be available and meet the Participant’s requirements, that access will not be interrupted, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to the Participant’s equipment including computer, tablet or mobile phone. The Participants have sole responsibility for providing adequate protection and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for viruses or other destructive properties.

6.2 Without limiting to the foregoing, all information and materials contained in the online registration portal and/or Official Website are provided on an “as-is” basis. The Organisers assumes no responsibility and shall not be liable (to the extent permitted by law) for any damage or injury arising out of your registration and participation in the BCCS Challenge 2021 or access to the online registration portal and/or Official Website, or any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, interception of online communication, software or hardware problems (including without limitation loss of data or compatibility problems), whether for breach of contract, tortious behaviour, negligence or under any other causes of action.


7. THIRD-PARTY WEBSITES

7.1 Where the Website contains links to other sites and resources provided by third parties, these links are provided for the Participant’s information only. Such links should not be interpreted as approval by the Organiser of those linked websites or information the Participant may obtain from them. The Organiser has no control over the contents of those sites or resources.


8. WAIVER AND INDEMNITY

8.1 By using and accessing to the online registration portal and/or the Official Website, and by taking part in the BCCS Challenge 2021, the Participant agrees, to the extent permitted by law, to indemnify and hold the Organiser, its directors, employees, its sponsors, agents, and third-party service providers harmless with respect to any claims arising out of your breach of these Terms, your use of the online registration portal or any action taken by the Organisers as part of its investigation of a suspected violation of these Terms or as a result of its finding or decision that a violation of these Terms has occurred. This means that the Participant cannot sue or recover any damages from the Organisers, our directors, employees, sponsors, agents and third-party service providers as a result of the Organisers’ decision to remove or refuse to process any information or content, to warn you, to suspend or terminate your registration or your participation in the race, or to take any other action during the investigation of a suspected violation or as a result of the Organisers’ conclusion that a violation of these Terms has occurred, to the extent permitted by law. This waiver and indemnity provision applies to all violations described in or contemplated by these Terms.
